Notice to Owners and Renters

RUNAWAY RENTALS USER AGREEMENT

You are responsible for conducting your own investigation regarding any and all claims made by potential renters and vacation property owners. You assume all liability for use of any information you find in any RunawayRentals.com publication. Owners are responsible for the accuracy of the information on their Runaway Rentals listings.

You agree to defend, indemnify, and hold harmless Runaway Rentals and its owners, employees, and agents for any loss, damages or costs, including reasonable attorneys' fees resulting from any third party claim, action, or demand related to your vacation rental listing or its use.

In no event shall RunawayRentals.com be liable for any special, indirect, punitive, incidental, exemplary or consequential damages, or any damages whatsoever resulting from loss of use, business data or profits, litigation and the like. You acknowledge and agree that the limitations set forth above are fundamental elements of this agreement and the site would not be provided to you absent such limitations.

The Runaway Rentals web site is provided to you on an as-is, as-available basis. Runaway Rentals and its owners, employees, and agents disclaim all warranties, expressed or implied, including, without limitation, the warranties of merchantability and of fitness for any purpose. Runaway Rentals shall not have any liability to you for any failure or delay to maintain or provide you any services offered by Runaway Rentals.

MODIFICATIONS TO AGREEMENT
You agree, during the period of this Agreement, that we may: (1) revise the terms and conditions of this Agreement; and (2) change the services provided under this Agreement. Any such revision or change will be binding and effective immediately on posting of the revised Agreement or change to the service(s) on our web site, or on notification to you by e-mail or regular mail as per the Notices section of this agreement. You agree to review our web site, including the Agreement, periodically to be aware of any such revisions. If you do not agree with any revision to the Agreement, you may terminate this Agreement at any time by providing us with notice by e-mail or regular mail

SOLICITATION
Pursuant to US Code, Title 47, Chapter 5, Subchapter II, p. 227, any and all non-solicited commercial email sent to RunawayRentals.com and or its advertisers listed within this site are subject to a download and archival fee in the amount of $500 US. Emailing denotes acceptance of these terms. At no time will Runaway Rentals sell or give personal information to any third party entity.

COPYRIGHT
The Runaway Rentals web site is owned and operated by Runaway Rentals, and is protected by international copyright laws. Runaway Rentals reserves all rights with respect to the Runaway Rentals graphics, logos, marketing tools, and other documentation under all applicable laws for the protection of proprietary information, including, but not limited to, trade secrets, copyrights, trademarks and patents.

CREDIT CARD CHARGE BACKS AND NSF CHECKS
You agree that you will not charge back any amounts previously charged to your credit card by us. If you charge back a credit card charge for a payment initiated by you, you agree that we (Runaway Rentals) may recover the amount of the charge back or NSF check as well as any and all fees incurred by the charge back action by any means necessary. The current charge back fee is set at $25.00 per credit card charge back. NSF (non-sufficient funds) checks will be charged $30.00. Furthermore, if you initiate a charge back of a previous credit card charge, access to your vacation rental listing(s) may be denied until payment is made and your account may be terminated, both at our (Runaway Rentals) sole discretion.

You agree to pay us all registration fees as shown on our Rates schedule. We reserve the right to change the existing Rates schedule at any time at our sole discretion. All fees are non-refundable. Your listing may, at our sole discretion, be canceled if any fees are unpaid on the date they become due.

ACCEPTANCE OF AGREEMENT:
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF THE SERVICE AND ARE NOT RELYING ON ANY REPRESENTATION AGREEMENT, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.
